Sand Bypass System
Although the DEIS makes reference to a proposed sand bypass
system, information regarding the system's design and how it will
function is lacking.
Based on a 1997 Texas General Land Office commissioned peer review
concerning the feasibility of opening and stabilizing Packery
Channel, the peer review assessment team concluded that a complete
channel design should be developed for the project. The design
should include an appropriate sand management program which would
also contain a monitoring program and sand bypassing response
element with established thresholds. The DEIS does not reference
or utilize the aforementioned peer review assessment. As staled
earlier, TPWD is concerned with sediment transport ink) areas
which contain sensitive habitat types, and therefore recommends
that the sand bypass system be fully described and properly
referenced in the FEIS. more...

Comment - If sand can be provided by other dredging activities to nourish the
beach and salinity improvement benefits are negligible what other benefits will be achieved by the
proposed opening of Packery Channel? Neither the EIS or the BA provide a clear
history of past flooding and/or deterioration problems to this area that have been
identified as needing to be or will be remediated by the proposed project.

"No Action Alternative" over the proposed project...

Recommendation -
The DEIS offers little evidence
that the project purposes would be achieved. We therefore ask that
the Final EIS provide more information in the areas address above
to support the project purpose and need. In view of the current
analysis, we find and recommend that the no action be considered
the least damaging practical alterative and therefore recommend
its Selection as the preferred alternative.

Fisheries recommends that a Department of Army permit NOT be
granted for the dredging of Packery Channel as currently proposed.
In a letter dated July 29, 2002,
National Marine Fisheries Services (NOAA Fisheries) made the recommendation
along with a request for a written response from the Army Corps of
Engineers. The deadline for the written response is 30 days from the
receipt of the letter submitted to the Army Corps of

- FISH AND WILDLIFE SERVICE
The purpose of the BA is for the Corps to identify listed species that occur in the project area to
determine whether the project as proposed "may affect" those listed species. Upon completion
of
that determination, the Corps submits the BA to the Service for review and requests concurrence
with their determinations prior to finalizing the BA. If the Service concurs there will be "no affect"
to listed species, the informal section 7 consultation process has ended. If the applicant, in this case
the Corps, concludes the project, as proposed, will result in a "may affect" or if the Service does not
concur with the "no affect" then formal section 7 consultation is recommended. The formal section
7 consultation process will result in the issuance of a biological opinion expressing the Service's
determination as to whether impacts associated with this project will or will not result in "take" and
jeopardize the continued existence of a species and/or adversely modify critical habitat.
The Corps has determined negative impacts will result to the piping plover and four species of sea
turtles, but that those impacts will not result in jeopardy. Therefore, it is the Service's interpretation
that the Corps is actually concluding that there is a "may affect" to those species and recommends
the Corps enter into formal section 7 consultation.

Where is Roy Miller
when we need him?

Roy Miller was elected mayor of Corpus Christi in 1913. Known as a "boy wonder", this former newspaper reporter created an administration, which paved muddy streets, organized our first professional fire department, laid sewer lines, and installed the municipal water system. His term ended in the same year as the devastating 1919 storm. But his public service went on for decades.
It sure seems like Roy Miller could get us through the Packery question successfully. He had a vision of Corpus Christi's future that transformed us from a fishing village and minor resort into a diversified modern city. Some people still believe in that vision; that we can do the planning, the financing, and the building to make our barrier island resources world-class resorts. If anything, I would fault the pro-Packery forces for having too small a vision. If you're going to do something - Do it right or don’t do it at all.
